Who is the controller of your data?
BKOOL, S.L. (hereinafter, "BKOOL") is the owner of this website. Its corporate data is provided in the legal notice.
Bkool is responsible for processing the personal data that the User provides through the website and is committed to protecting the personal data of everyone with whom it deals and respecting all legal requirements in terms of data protection with the utmost guarantee of confidentiality and security.
How Bkool processes user information
- To create an account through the registration form
We request the user's name, surnames and an email address to process the registration. In addition, the user is asked to create a password that will be used, together with his email, to log into his user profile.
It is necessary to provide this information in order to complete the registration.
- To buy products on Bkool
If the user purchases a trainer through the Website, they will be asked for certain personal information in order to complete the purchase thereof.
If the user wants to become a Premium user, which implies purchasing a subscription to the Simulator, they are asked for certain additional information through the form in order to complete the purchase based on the payment methods offered.
Bkool uses third-party payment services to manage purchases. These providers satisfy the security standards required by the regulation for payment providers. Bkool does not store any of the user's credit card information.
- To manage the user's account
Users can add additional information to their profile, including a photograph, to manage their participation in the application and the way they want to be seen by other Bkool users. The public profile is set up by default to be private and it is the user who can decide what personal information other Bkool users can see. The user can also decide what information to share with others, such as ranking, leagues, groups and friends.
Once registered, a user can manage his history, activity details, calendar, plans, import Garmin activities and more.
- To use the Simulator's features
For example, when pairing devices with the Simulator, such as the Bkool trainer itself or the user's heart rate monitor. The user can also choose what types of sessions and routes to ride on the simulator and to save the result of his various sessions if they so decide. The user can also choose to delete them.
If the user connects devices and applications to the simulator, Bkool collects and processes the information provided by these devices. This may include health data, which can be inferred from aspects such as heart rate, height, weight and other indicators provided by the devices themselves or entered manually by the user.
Also, we may process the user's location information if the device is set up to share this information or if it is provided by the user.
- To invite friends
If the user decides to invite friends to Bkool, we process the friends' email addresses to send them the invitation. We do not store those addresses once the invitation is sent.
- To communicate with Bkool through the various contact forms available on the website
A user, whether registered or not, can use the forms available on the website to send enquiries to Bkool regarding its products and services.
Basis for Bkool to process user information and why it processes it
The basis for processing the information needed to purchase a trainer and Simulator or a Premium account is the need to process said information in order to complete the user's purchase.
Our purpose for processing the information is directly related to the management of the service provided to the user through Bkool, to the use of the simulator by the user and/or to the purchase of the trainer.
The user may receive email notifications related to the service's activities. These notifications include notices involving friendship requests, activity reports, challenges, comments on photos and messages, and information and offers from Bkool, and, specifically, all the options described in the "notifications" section of the user's settings panel. From this settings panel the user can specify which notifications he wishes to receive from Bkool, if any. The communications received by the user also include a link to unsubscribe from said communications.
Disclosures to third parties by Bkool
The use of the services provided by Bkool may require disclosing the user's information to third parties. For example, if the user chooses to pay by card, the credit card data will be stored by a payment provider called PAYTPV, which is in charge of storing that data in a secure manner that meets the security standards required by Bkool for its suppliers.
Likewise, in the event that the user chooses the payment option for "financing with Aplazame", his data will be released to Aplazame, a company dedicated to financing through consumer lending, in order to manage the user's financed payment of the user who choose this payment option.
In order to send the trainer, the user's contact information will be provided to the transport companies so they can ship it to the address provided by the user.
Moreover, the technology that allows Bkool to provide user services is contracted with Amazon Web Services, a secure system infrastructure provider whose servers are located within the European Economic Area.
The user can decide when he wants to delete the data they provide through the user profile and application history. Once the user decides to delete it, Bkool will not store this data. This data will be stored for as long as the user decides to be registered with Bkool. If the user decides to cancel, Bkool will delete their data, with the exception of data associated with product purchases, which must be stored for as long as legally required by law. We will also store the user's email for five years to track the users of the simulator trial period and avoid undue abuse of this trial option. To delete an account, the user must write to the following email address: email@example.com.
Exercise of rights
Data subjects may exercise their right to access their personal data, request that it be corrected or deleted, limit its processing, object to its processing and the right to portability by sending an email to the following address: firstname.lastname@example.org. In any case, the user concerned must attach a copy of his/her national identity card, passport or other valid identification document. If the exercise of these rights is not to the user's satisfaction, he may file a claim with the Spanish Data Protection Agency.
In addition, the user can contact the data protection officer at this same address.
The user's personal data is processed by Bkool in the strictest confidentiality. Bkool takes all necessary technical and organizational measures, depending on the data type, to avoid the loss, misuse, alteration, unauthorized access and theft of the personal data that is processed.
Restrictions for minors
It is strictly forbidden for minors under the age of 14 to provide personal data to Bkool. In addition, purchase transactions can only be made by adults. If anyone under the age of 14 provides information, or under the age of 18 makes a purchase, their parents or guardians are solely responsible for this circumstance. If you are a minor, please ask your parents or guardians to contact us.
Bkool owns accounts in various social networks (Facebook, Twitter, Google+, Pinterest, YouTube and Instagram). The processing of said data by Bkool is as allowed by the social networks themselves through their services. Bkool does not extract personal information from said networks on those networks' followers and users. Bkool uses these social networks to advertise its services and offers related to the platform itself, in compliance with the contracting conditions established by the owners of the social networks themselves.
